This Dress Rental agreement (the “Agreement”)
BETWEEN:                 

"CUSTOMER”
means any natural or juristic person who borrows the Clothing for the Period
from the Owner through Upper Chic Rentals;

AND:

 Upper Chic Rentals (Pty) Ltd Registration Number [2023/192886/07] a private company
organised and existing under the laws of South Africa

(“Upper Chic Rentals”)

 WHEREAS the Renter wishes to rent Clothing from Upper Chic Rentals

WHEREAS Upper Chic Rentals wishes to act as agent on behalf of the Renter
to facilitate the loan of Clothing to Renters for the Period

Upper Chic Rentals - Terms and Conditions

1. Acceptance of Terms

By accessing or using the services provided by Upper Chic Rentals ("the Company"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.

2. Rental Agreement

2.1. By renting a dress, customers agree to abide by the rental period specified in the agreement and return the dress in the same condition it was received, with normal wear and tear expected.

2.2. Dresses not owned by Upper Chic Rentals but rented through Upper Chic Rentals on behalf of lenders will require a deposit which will be refunded on satisfactory return of the dress.

3. Booking and Payment

3.1. To secure a dress rental, customers must make a reservation through the Upper Chic Rentals website or in-person at our designated locations.

3.2. Rental fees are payable in advance and are non-refundable. Late fees will apply for dresses not returned by the agreed-upon date.

3.3. A security deposit may be required and will be refunded upon the satisfactory return of the dress.

4. Dress Care

4.1. Customers are responsible for the care and safekeeping of the rented dress during the rental period.

4.2. If the dress is damaged beyond normal wear and tear, customers will be responsible for repair or replacement costs, which may exceed the initial security deposit.

5. Cancellation and Refund Policy

5.1. Cancellations must be made at least 7 days before the scheduled rental date to be eligible for a full refund.

5.2. In case of a cancellation within 5 - 7 days of the rental date, a 50% refund may be provided

5.3. In the case of a cancelation within 1 - 3 days of the rental date, no refund will be provided.

6. Size and Fit

6.1. It is the customer's responsibility to ensure the selected dress size and style is suitable for their body type and event. If the dress does not fit please let us know, if the tag on the dress is removed we unfortunately can not refund you, if the tag is still on the dress you will receive a refund less delivery fee.

6.2. Alterations are not permitted

7. Shipping and Returns

7.1. The cost of shipping the rented dress to the customer and the return shipping is the responsibility of the customer. Shipping costs include delivery and return.

7.2. Dresses must be returned in the provided packaging with the prepaid return label.

7.3 Note late fees will apply if you do not return your rental on its return date or you fail to meet the courier.

8. Ownership and Copyright

8.1. All dresses remain the property of Upper Chic Rentals.

8.2. Customers may not reproduce, modify, or create derivative works from the rented dresses.

9. Privacy Policy

9.1. Upper Chic Rentals respects the privacy of its customers. Our Privacy Policy outlines how we collect, use, and disclose personal information.

10. Payment

Our payment providers are Yoco and Paygate

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of South Africa, and any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

By using Upper Chic Rentals' services, you acknowledge that you have read, understood, and agree to these Terms and Conditions in their entirety. Upper Chic Rentals reserves the right to modify these terms at any time, and such modifications will be effective upon posting on our website. It is the customer's responsibility to review these terms regularly
